Yes, they are illegal here. You can contact the DPS at 512-424-2000 to ask the about the fines. They will probably direct you to Texas transportation code section 547.501. There is another that will cause you to fail inspection if they find out you have an air horn used as your on road warning device. You can however have it connected to the vehicles theft alarm.
