Pretty simple. If a peril isn’t covered on your insurance policy, it has to be listed in the policy exclusions.
So, for what you claim to be true, the policy would have to have a stated exclusion of “towing weight in excess of the tow vehicles published maximums”. I’ve never seen or heard of such a exclusion, but the OP is welcome to to check their policy (as are you).
And as far as “lawyers having a field day”, isn’t that what lawyers do? People can sue for anything. That doesn’t mean they will win.
