It is not illegal except in places so posted with signage, such as tunnels/ferries.
The amount of spilled gasoline required to allow the burner flame to become an issue is so large that you would have to be an absolute clueless idiot to still be standing there fueling your vehicle under those conditions and the gene pool won't miss you.
It is simply an outdated nanny state requirement similar to how we all used to have to turn off cellphones when boarding an airliner because the plane was going to crash if we made a call.
My propane is always on, though I have a compressor fridge so there is no flame to worry about unless my water heater kicks on.
