My 09 has been flawless with operation, but I can speak from experience on the differences in MPG of pre and post emission equipped Duramax trucks - I have two.
My 06 can get up to 22 mpg on the highway. My 09 never tops 16 empty.
I will put the 09 to a max mpg test in a week or so and see how good I can get out of it again. I rarely drive it empty.
