Diesels create A LOT of NOx due to their compression ignition which creates high combustion temps. When combustion temps reach 2,500F or more, NOx is being created and is also when the engine is running most efficiently. To lower NOx output, the EGR recirculates cooled exhaust gases to lower combustion temps which also lowers the peak performance and the efficiency of the diesel engine. This is why engines under less strict NOx emissions like the Euro 6 are able to make more power versus stricter NOx requirements like the US EPA regulations.
This is changing with the addition of better SCR technology since most NOx reduction will be after the engine and you no longer have to lower NOx in engine which decreases power and efficiency.

Yes you know nothing about diesels. A. Small increase in NOx does not have a huge effect on power. Bit different if you run run considerable N0x into the engine, then the Oxygen is separated by the heat.
Still the issue is and it is a major one will FCA be fined by the EU?
Not exactly small fines either PACCAR had to pay $1billion just for price fixing
