I was indirectly involved in the development of the 6.7L PowerStroke Diesel engine.
First, the base engine is "all Ford". Navistar tried to sue and so did another manufacturer but both dropped their lawsuits when Ford showed how the base engine development was done by "black box" engineers (engineers who no involvement withe the other programs).
Second, the claimant position was that Bosch (admittedly guilty of diesel emission cheating) did provide "some" of the software for the engine controller but not a "significant" amount. Yes, there are Bosch component (fuel injectors) in the system. The current system uses an ECU maybe a 3rd party. There was no "fruit from the poisoned tree". Ford accepted all responsibility for the total product.
If there was anything to this, the EPA and CAFE would be all over it like ants on honey !
