Yes it would have to be underslung (springs under the axle) for the u bolt to be pointing down. As JJ said I would be interested to see why it's too long, whether it was replaced with one the wrong size, or a spacer or part was left out from the installation.
Even if the axles had completely lost their camber and the springs were totally shot, none of that would affect the relationship between the U bolt and the lower edge of the rim, so I say this inspection shop is full of BS! I would get your unit out of there before you get ripped off any more.
