Meh, if he's been a good neighbor I'd settle up as best possible (is he on a very fixed income and could not afford $1000 fix?).
Get it fixed or fix it to the best of your ability, that will allow water in and cause you some issues.
I'm sure if I hit 92 I'll do some dumb stuff myself...I do it now and I've got a sound mind and body! Lol
