Too many unknowns to place any blame here. Hope they found the dog.
The new 2013 Dodge trucks do just that. They have a trailer sway control built in the ESC control. If a sway event is detected it will reduce speed and brake isometricaly until the sway event is reduced, Yaw rate is canceled.
