I'm not sure about civilian law. I doubt Trailer Life was trying to hit a legal term at all. Just strongly stating that it should not be done.
Regarding "should" vs "shall" in manuals, in the words of my old VP of Flight Ops, " those who treat should as shall, should remain employed".
