Again, this is a fleet wide challenge. They meet emissions. This is a calculation of mpg to arrive at this co2 per mile. here is some reading and here
They are trying to make it seem like they are hooking these trucks up and they are failing an emissions test. It is a calculation based on the mpg.
VW failed emissions testing. This is not the same thing.
