If I run a stop sign and kill somebody, insurance will pay the claim. If I'm driving drunk and run somebody over, insurance will pay the claim. If I am speeding and have a crash, insurance will pay the claim. Same with overweight....they may not renew my policy due to any of the above, but just because I have an accident while I am breaking the law doesn't mean the insurance company won't pay.
Think about it, most accidents happen because somebody did something illegal. If the insurance company was allowed to NOT pay based on that, insurance would be worthless.
