The auto industry produces a compromise solution that is best for average users, and meets emissions requirements. They are well aware of what you can do with a tuner. It is possible to get better fuel economy at the expense of power. It is possible to get more HP at the expense of mileage. What the tuners allow you to do is choose. Typically tuners also don't worry about emissions, but allow you to save the factory setting to reload in case you need an annual emissions check.
