Okay that is fine, but that is not what was written. The way you wrote it is that the axle was not able to take the gross weight of the trailer, and I was merely pointing out that axles will often max out at less than the GVWR, since the tongue weight has to be accounted for. That was the case with my RV which did not have a problem.
Now if the manufacturer shipped the RV with the wrong tires (14" instead of the stated 15") and you will be compensated then that is a different issue.
