I am going to say taking a small fuel sample of a vehicle in for service is legit.
When you go in, the signed authorization will permit that.
No different from down dumping all the data inside the boxes.
Two issues here:
1. Original Owner or subsequent owner
A. Warranty registration (first owner) gives the OEM certain rights/ownership to data stored in the ECM/PCM/BCM/"black box" for multiple purposes including safety/product improvement/warranty.
B. Subsequent owners are not specifically encumbered this way but OEM's treat all customers the same in this regard to data/sampling.
2. Service Order/Release of Liability at time of service -including "free" services. Wording on Work Order would be a key part as this falls under State level jurisdiction as a consumer transaction. Some States protect the consumer greatly in motor vehicle service transactions. Some not at all.
