Based on the data to date, there is not sufficient data in the public domain to prove a defect.
Maybe deficient design is a better description? Will it take a death and loss of life before something changes over at NHTSA? From my perspective, I use the test of reasonableness, and is something foreseeable to potentially cause an accident, a death, an unnecessary injury? If so, I see liability issues involved.
