Maybe deficient design is a better description? Will it take a death and loss of life before something changes over at NHTSA? From my perspective, I use the test of reasonableness, and is something foreseeable to potentially cause an accident, a death, an unnecessary injury? If so, I see liability issues involved.
BUT....you are being reasonable with a long term vision...
Bean counters (that includes our current regulatory agency heads of
state) are mainly quarterly goal'ed, so that is their horizon or vision
Some poor soul will have to give up life or limb before enough public
out cry will drive them into action
