Some myths and dated info here.
Baja is not a "free zone" other than TIP-free (only for autos), and this has nothing to do with FMM.
FMM in Baja is required for most tourists, and as of this month it is MXN 500 ($US 25), not MXN 350. They regularly raise FMM cost in pesos as peso is sliding lower. This $22-25 FMM has been in place for at least 12 years, has nothing to do with the Wall.
Exceptions when FMM is not required or is free:
FMM is not required when you are staying within 50km zone (zone boundaries vary, but usually within 50km) AND if you stay doesn't exceed 72 hours.
FMM is required (though often not enforced) if you stay up to 7 days, and in this case it is issued free of charge.
Certain crossings are now issuing free FMM to all tourists who want to stay under 7 days, including those who stay under 72 hours. I don't know if there have been actual changes to the law that have caused this, but this is what border agents are doing now. And, btw, make sure you return free FMM when going back North, or you'll be fined next time you enter Mexico. Paid FMM they don't seem to track since they already got what they wanted - $25.
