Not sure what it is in Pennsylvania, but here in CA a fallen tree is usually considered an act of God where the neighbor, in this case, would not be liable for the damage to the trailer - only for the removal of the tree. I have a friend that just went through this (i.e. his tree fell on a neighbor's storage shed). There are exceptions if the neighbor had previously been formally notified/warned that the tree was a threat due to lack of maintenance, disease, etc. Thus, OP's own insurance will likely cover the damage. - MFLNomad II"If I understand, it was your neighbor's tree, correct? Things may differ in other parts of the country, when it comes to liability home owners insurance. In my experience, if the wind (act of God) blew my tree over onto my neighbors camper/house/property, my neighbors insurance would be responsible for damage, including tree removal, the part on neighbors property. OTOH, if I was cutting my tree down, and it fell on my neighbors camper, I (my insurance) would have to pay.
Don't you just love internet arm chair lawyers. :)

It WAS my neighbors tree.... We spoke to the Insurance company last night... They said that it is considered an act of god and Our Insurance will cover it.. The only things the neighbors insurance would be involved in is if there was any property damage to the surrounding area...
We will loose 3- 4 arborvitae trees when it's all said and done that they will pay for.
our Insurance ( Progressive ) have already told us exactly what to expect since we paid for Full Replacement coverage when we got this RV.. Basically they said that they would give us a check for the sale price and tax paid once it is determined totaled or not..
I really would have no idea how this wouldn't be totaled... There are 1/2 of the roof trusses broke, the entire roof and structure needs replacing... The entire curb side needs replacing.. The floor is gone for about the first 8" along the curb side.. the street side slide is racked.. the interior roof is buckled from the rear window to the front bedroom.. - laknoxNomad

That is my goal.... I still need to get the insurance guy here to see, and then my neighbor needs to get his tree guy..Then I will go in and start looking, and emptying...
What can you say but, I'm d@mn glad you guys weren't hurt. If I understand, it was your neighbor's tree, correct? Dealing with 2 insurance companies can be a right pain. My suggestion is to insist your company to make you right, quickly, and tell them to duke it out with the other company. For the short term, you might look at a rig to "get you by" until you can find a new one.
This brings to light one of the greatest weaknesses of the RV industry as a whole; no dealer network. If this were your truck, you could scour every dealer in the country for an identical (or nearly so) truck and have an answer in under an hour. If the mfrs really cared, they could do nearly the same thing by sending out an alert to every one of their regional sales teams as they =should= know who has what and to hell with the "buy local". Probably have an answer in 48 hours.

Brent, My wife told me she wanted a new RV in the driveway before Memorial Day...I am not sure that will work, but we will try.Thanks for the info, I will look at them, but I believe she wants new...???
