LLC and SD RV registration

We currently have an LLC in Montana with our rig being registered under the LLC. If we chose to dissolve the LLC and register the rig in South Dakota, what are the ramifications? Thank you for any input you might have.

  • We have the same, we are keeping the Rig and Jeep in the LLC. We checked into SD licence requirements. Registration then cost per year for tags. It was less expensive to maintain the LLC. Since SD is only our domicile, and we do not stay in the state for more then a few days a year. We are keeping the LLC. You really need to read the requirements per state on LLC. Example Arizona (live for 33 years), you must shown your vehicle was not in the state for 6 months out of a calendar year or if commercial vehicle, you do not have a office in the state.

    It is all about what the requirements read.
  • There is a 3% Excise Tax in South Dakota on your net purchase price, but no Luxury Tax. If you have already paid a Excise or Sales Tax above 3% to a different state, you need to have complete documentation of that as well.

    If you paid more than the 3% then there will be no tax owed. If you didn't pay any tax, the you will have to pay.

    Didn't you see he's a California resident? They are cracking down on LLC's in Montana for escaping tax obligation. South Dakota does not, at this time, report LLC ownership to California. A court order may change that in the future. Why not just move to SD (change license, insurance, medical, etc.) to a SD mail forwarding service?

  • Well, assuming you did not pay sales tax when you bought it you will pay what they call an excise tax in SD. I believe it to be 3% but not sure if that would be on the original sales price. You can call any of the mail forwarding services in SD and they would be happy to give you the correct information. America's Mailbox, My Home Address (Emery, SD), just google mail forwarding in SD, there's quite a few. We have used My Home Address for 7 years and have been very happy with them.
