I am sorry that you did not get your deductible back but wanted to share with you how this process generally works. I was a manager of a collections/subrogation group at a larger carrier. Most companies work through a company called Arbitration Forums. For smaller claims everything is submitted in writing. There is no chance to state your case verbally or meet face to face. You have no idea who at Arbitration Forums will decide your case. It is totally up to the arbitrator to read the material and assign blame for the accident or possible assign some to each driver. I had cases that seemed very cut and dry and they went 50-50. Others were I thought we probably would lose we won. Most of the time they are pretty good but once in awhile you just get a bad arbitrator who did not spend the time to read through all the material. Carriers do this because the costs to take these claims to court would exceed the amount that could be collected. Keith
