In that case this is all moot as the scooter rack doesn't count on the 40 foot length determination on the road restriction either. So you were legal.
Opps, I lied to you. I read it again and there are some exceptions, but since your rack is used for carrying a load (the scooter) it is supposed to be counted in the overall length for road restrictions. I don't know how picky CHP would get on that one.
