Damages and Repairs

Hello and thank you in advance for any input, ideas, suggestions or responses. Hope this topic is useful for others as well.

Our 2002 HR Endeavour was parked at Oasis RV Park in Las Vegas - we paid a premium for two long spaces so we could park the motorhome and two cars. Sometimes we left for extended periods of time, during which we paid full site pricing to keep all on same site, rather than move to storage.

On one return (a little over two yeas ago), we discovered that someone had backed into the drivers side rear of our 38' DP - no note left, and no one said anything to the office/security - at least that's what they said.

And, don't know if the following is still an enforced policy: They only permitted/allowed certain vendors onsite for repairs, maintenance and such. The vendor that makes solar screens is awesome - nice guy - great work. BUT the ONLY vendor they allowed to wash/wax inside the park used product/s that compromised the clear coat in several areas - peeling and looks like a really bad case of sunburn peel. Needless to say, no one admitted to any wrong doing.

When we politely - and privately - brought the two issues up with mgmt. we were 'invited' to take our business elsewhere. We moved to another facility where it is in covered/shaded storage.

Insurance says no coverage.

What would you do ?

  • The RV park is not responsible for damage to your rig caused by the collision of another driver. It's no different than getting your car hit in the parking lot of a grocery store. The store is not responsible.

    As for the damage from the vendor, you'd have to take it up with the vendor. Just because the RV park allows them to come into the park does not make the RV park responsible.

    I'm not an attorney, and may be wrong. But you can certainly consult with an attorney to get a legal viewpoint. If they think you have a case, you can retain them to represent you.

    What would I do? I'd evaluate my insurance coverage to make sure I'm covered in the future.
  • I'm not sure what you expect the RV park to do they aren't going to be watching your RV 24/7. Essentially when you left it was like being in storage while you were gone for a long period of time. Just like when mine is in storage right now and the storage owner isn't responsible for damage that goes on there. But my insurance is and I don't understand why you have allowed your insurance to get away with not covering your damage. You don't have to be present and witness who backed into it just that it happened and now you want your coverage that you are paying for. If my insurance didn't cover repairs for whatever reason I would tell them meet me in court.

    If it happened in a Walmart, or Vons, or Ralph's parking lot, would you hold them responsible? Probably not.

    I don't think there is much difference.

    The choice to use the vendors was yours. The park approved them as some parks do.
    Where I am for the winter the park has to approve all vendors. The vendor must show insurance to indemnify the park should there be a lawsuit. the park assumes no liability for the vendor.
