We are LEGALLY registered residents of South Dakota and full time RVer's. When we purchased our RV as well as our tow vehicle we paid sales tax to South Dakota. Our drivers licenses are South Dakota. Our voter registration is South Dakota. Our vehicle insurance is South Dakota. Each year we renew or tags and pay all associated fees in South Dakota.
In order to legally do this we sign an affidavit stating that we do not own property in any other state that can be claimed as our primary residence. It is officially classified as "Nomad" status by the state of South Dakota. Everything is perfectly legal as long as you are truthful and follow the rules. To say that just because we choose to claim South Dakota for our residency that we are liars or tax cheats is insulting to those of us who did the research and choose to save our money to take care of ourselves in our retirement rather than having to rely on the government for handouts.
This is claiming domicile. 99% of full timers use this. Anyone pointing fingers at the SD domicile hasn't read the thread.
Filing for domicile in SD, is NOT filing a false LLC to avoid paying state taxes on an RV which is what the OP is about. 2 DIFFERENT animals.
If you are audited and asked to produce your financials on your "LLC" and the ONLY piece of business you have on there is the registration for your RV, AND you don't live there..........Just WHAT do you think the feds are going to do to you?? LLC Limited Liability COMPANY, not an illegal tax shelter for your RV. Same as filing a false return. Will they catch you or not? IMHO not worth the cost of the tax on the RV. :R
Anyone can report to the IRS the name of a person or any company anonymously if you think they are doing something illegal.
All Montana has to do is send the owners names of the LLC's that the owners of the business don't reside in Montana to the IRS and sit back.
