Montana LLC Re-Visited

Hi guys,

I recently spoke to someone who became a full timer and the conversation was interesting. He told me that he sold his home in New York and set up a Montana LLC. He then purchased a new MH and a Toad and said he saved $53,480 in taxes between the two vehicles.

He said a couple months larter he went to Florida and set up a domicile and got a Florida drivers license. This got him away from what he called exorbident NY taxes.

He then went back to Florida 14 months later and reregistered his MH and car in Florida with $0 tax implication. He paid a small fee to re-title in FL and paid the standard plate fee.

I asked how that was possible and he said Florida does't make you pay the tax if you owned the vehicles for 12 months or more. He said since then Florida has changed the 12 months to 6 months!

    Ask him if he is collecting Social Security? And then ask him how much he has collected BEYOND his contributions during his career? And then ask him what medical insurance he has.

    I hope he is busted at some point.

    I would have made him buy his own coffee....
  • It is not the Fed's but the states where you have a domicile.
    Each state is different, in Arizona as long as you can prove your rig was not in your position for 6 months out of a calendar year. Then yes a Montana LLC is legal.
    The firm where we did our LLC, provided to us the Az. status on vehicle position and LLC's. The big part was out of state companies, that were not required to get an Az licence as LONG as they did not have an office in the state.
    You have you read your States Statues.
  • Remember too, the key words there are FULL TIMERS....full timers can, with certain caveats, dictate their intended State of Residency. The Feds, look to see where you bank, your DL, where you vote, and many other items to determine your intended State of Residency. If you only use the Montana LLC to avoid taxation, you could find yourself in a world of hurt...do your homework, follow all the instructions to a TEE, and you'll probably be ok. We chose South Dakota because it's RV friendly, low sales tax and no income tax. But we vote there, bank there, have Dls from there etc. even though we don't own property there....Dennis
  • I was shopping at a local grocery store and saw him pulling in. He was driving an American Eagle coach with a Jeep Cherokee toad and it was an attention getter.

    When he came in I told him my wife and I were considering the Full-Tme motorhome experience and he lit up like a lightbulb, more than happy to talk with me. There is a Starbucks in the store so I bought him a cup of coffee. I paid because I felt bad for him having to slum it with an American Eagle. :)

    I saw that he had Florida plates and asked him if he lived there long, I lived there 30 years, and he said "well if you add it up maybe a total of 8 days"! Thats when he gave me the information mentioned above.

    That's all I know other than RV people have been some of the friendliest people I've met in many-a-day...

  • Do a search on the Montana LLC. They (the feds & the state) are very aware of illegal LLC's and have cracked down on this and anyone doing it IS under a microscope from the day they set it up. IMHO not something I would want to be under waiting for the second shoe to fall.
    There is no statute of limitations on fraud. :W

    Seems to me a MUCH simpler way to have done that was to set up the 'so-called' domicile in Florida FIRST, buy the RV and have it registered in Florida AT the dealership and therefore pay the lower Florida tax. Did your friend fake the Florida address too to obtain the DL?
  • Sounds like a no-brainer to me. Why don't you try it and come back on here 2 yrs. from now and report your success, or your failure. :S
