Not quite "next week" but the Grand Jury issued their indictment last Friday.....Dennis

I think the fact that he hit the trooper is proof that he did not slow down enough to avoid hitting something.
The Tennessee Department of Transportation(TDOT, not the media) said that warning signs were put out two miles before the accident so you decide if he heeded those warnings or not. He obviously did not move over so all that is left is that he did not slow down or stop, unless you want to take the position that the TDOT is lying.
Exactly. Not only were there warning signs of lane closures that the RV driver has already admitted seeing, there was clearly slow traffic and shown in the video and there were clearly two vehicles with flashing lights stopped in the lanes of traffic. There was no blind curve. For whatever reason the motorhome driver was either not paying attention or maybe for some medical reason could not see the vehicles in time, but bottom line that police report is going to be 100% of the blame on the motorhome driver. When traffic is stopped on the freeway and you run into the back of it, in almost every single case it's going to be your fault. And that is even without warning signs and flashing lights on police cars. I feel bad for the motorhome driver as he clearly didn't mean to do this, but it's his fault. And yeah I'm speculating too, but my speculation comes with years of experience investigating traffic accidents. - msmith1199Explorer II

Yes your Honor, I saw the lane closure warnings two miles before the accident, and I had plenty of time to move over and/or stop. After a few miles I figured the signs were mistaken so I just kept going in the curb lane. :R
you highlighted my point exactly. two miles before, after a few miles, etc. etc. why do they have to drop the speed limit all the way down 2 or more miles ahead? drop it to 55, then 50, then 45, etc. rather than 45 mph two miles of clear highway before the incident. sort of like crying wolf.

I don't know about Nashville, but out here in California we don't have that many signs. - ferndaleflyerExplorer IIIOn those 9300 tickets mentioned above----I got one of those tickets from an un marked deputy sheriff parked on the shoulder of the interstate with no lights on. I had to slow down because the 2 cars in front of me did. I went to court and explained how I saw it, was told by the judge that they had to protect their law enforcement people out there on the Interstate (deputy sheriff)and was fined $160.....There were 9 others there that day that had been cited for the same thing by the same deputy sheriff. I wonder how many just paid the ticket and how much bogus revenue that county generated doing that?
- topflite51ExplorerA couple of years ago, I came upon a sign similar to one saying to slow down emergency vehicles ahead, the sign indicated 35 MPH instead I slowed to less than 20 and dam glad I did, if I had been doing 35 I would have rear ended the vehicle in front of me, instead it was the vehicle behind me that rear ended the other vehicle that was ahead of me. I always wonder why some drivers have to get ahead of another vehicle and hit their brakes just so they are ahead of one more vehicle. What is it about being one more vehicle ahead when the line is 1 mile long???????? :S
- rgatijnet1Explorer IIIAn article posted yesterday about a video taken at the time of the accident. Investigation

I agree with you, it seems to happen on these forums, people speculate many thing before it even goes to court, if it were a car involved or a pedestrian we wouldn't even be talking about thisrgatijnet1 wrote:

The warning signs did not say that they dropped the speed limit. The signs said that the lanes were CLOSED ahead. Closed means closed/blocked/impassable, etc. It does not mean that if you go slower or faster that you can get through that lane. It means that if you want to continue in that direction, at any speed, that you will have to move to another lane.
so you are saying that they did not lower the speed limit leading up to the closed lane area? that doesn't seem too bright to me.

Have you ever read any of the "move over" signs in the various states? Almost to the letter they all say "Move over OR slow down".
Here is the Tennessee law since that is the state we are talking about and since anyone driving in that state should be familiar with the law. It also clearly states to move over OR, to alternately slow down. An officer was killed because the RV did not move over OR slow down sufficiently even tho he was warned two miles in advance. Tennessee move over law
This was a preventable accident and I feel sorry for the driver of the RV but I feel more sorry for the family of the officer who lost his life.

But that is what we do here. :B
I note near the start of that video the commentator says "it is likely" or some such. well that likely cinches it.

I think the benefit of these Monday morning quarterback threads is that it might just make some chucklehead stop and think about what might happen. They always give you 2 miles of warning when closing a lane on the interstate but... I cannot count the number of fools who will drive right up to the closure and jam in. There should be a bounty, and no limit on these jerks.
