RV Accident

Dear Readers and Viewers:

Has anyone ever encountered a situation whereby your RV was lawfully parked in your yard and a wreckless driver loss control of their vehicle and hit your RV. However despite these facts the insurer is denying responsibilty for the loss of use of the RV. The owners have been without the use of the RV for approximately 8 months.

The insurer is denying any and all liabilty for the loss of use. Moreover the owners have been unable to take the RV on several important trips. Finally the owners bought the RV for its asthetic value and convenience. Additionally the owners are avid sports fans both locally and nationally. There eldest son was LSU's 1986 Final Four Basketball Team. The youngest was a game away from making it to the little league world series yearts ago. So they cannot follow sports like they use to and had envision when the RV was purchased.Please advise.
  • Usually auto ins policy's cover loss of use for normal vehicles. I suspect in his case they wont do that but I agree with the others, it's time to find a lawyer.
  • 8 mos is way too long unless they are trying to get much more than the NADA value and are refusing to agree on the adjustors settlement.

    When you're not at fault, in some states, you can have your own insurance pay the claim and they will go to the reckless driver's insurance to get reimbursed sometimes using their own lawyers. That's why it's important to call your own insurance company as well as contact the offending parties insurance adjustor, rather than just waiting for them to send a check.
  • I had a similar incident. Drunk Driver, suspected illegally in the country, no drivers license or insurance or assets. And promptly disappeared after a night in the drunk tank.

    I felt lucky my auto insurance paid to the limit of their liability, waved deductibles and said the trailer was probably worth more than I had it covered for. So, reading my homeowners policy, I found coverage there as well (limited to another $1000.00) so I got some from them to in addition to the homeowners needing to cover the damage to my house.

    I think it might be difficult to prove damages for loss of use, unless they had actual travel/RV rental expenses in the time their RV has been out of commission.

    If you really want to pursue it, you might need a lawyer.
  • Does the reckless driver have any insurance? If so is it a plain vanilla policy that is not worth much? In your yard your homeowners policy should provide some coverage. You family needs are the last thing the insurance company cares about. If all of the above fail then talk to an attorney sooner rather than later.

  • If this was 8 months ago, why hasn't it been fixed or totaled by now?? In either case, they should have an RV to use by now - their old one fixed or a new one to replace the totaled one.
  • I didn't realize that insurance covers loss of use. Unless it was your permanent home then how can loss of use be determined?

    Are the insurance company covering damages to the RV?
