When is a new RV not new?

Technically it's when it is titled by the DMV it officially becomes "used". If you borrowed money for it your lean holder wants the title as you hold the collateral. If no lean holder is involved, the moment money passes hands and you drive it off the lot it is still considered used. I sympathize with you as I too have been dealing with some serious warranty work FROM DAY 1 and I consider my motor home to be a lemon. To each is own.

How about buying a new RV (never registered) only to find out that the dealer had loaned it out. An onion was found as well as food marks not noticeable right away. Legally was it " new"

Unless you go pick it up from the factory, or the dealer is next door to the factory, pretty much all motorhomes get driven from the factory to the dealer. That's why almost all of the motorhomes in California have at least 2500 miles on them. And there's a good chance the guy delivering the motorhome also slept in it and ate in it. They also may have towed their ride home behind it.

1) Over 250 miles
2) Bed has been slept in
3) Toilet has been used

Absolutely if they stuck a used part ANYWHERE on the coach, it would be a USED coach. I would not accept used parts being thrown into a new coach at all.

OK, I have a 2014 pickup that now has 3000 miles on it so it is used, but, it still has the factory warranty on it that it did the day I drove it off the dealers lot (less the time/ mileage I have used it).
Your motor home should be the same.

But it is still brand new until the Manufacturers Statement of Origin in turned over to a state DMV in return for a title. Doesn't really matter what you think.

just be thankful that it doesn't have a tiny hole 7 ft. up in the side where a screw poked thru a bit.

Is not the Winnebago Via a MB Sprinter based RV. MB Sprinters have a 100,000/ 5 year warranty. I would NEVER have any work done on the Sprinter any place but MB. Sprinter approved Service Center, PS . MB would have only used new parts under the warranty.

I am not sure what your concern is. It became a used vehicle as soon as you drove it off the lot. The problem that you had was not with the motor home manufacturer, it was with the chassis manufacturer. Now the question is are you happy with what was done. If not you need to check into what your states stand is on the lemon law and try to return it. If you are pleased with everything I would get with the chassis manufacturer and tell them your concerns. If you word it correctly it is possible that they will extend your drive train warranty some amount greater then the original amount. Since your motor home may never be driven that far you might try to negotiate extending the drive train warranty from five to six years. The bottom line is that you are satisfied with what was done. I would think the RV dealer should take it to a service center authorized to do work on the chassis. In this case that would be a Sprinter service center. I'm not up on who all services Sprinters these days, but I think it is Mercedes Benz only. Dodge dealers may still be authorized, not sure.

I would look up authorized MB Sprinter service centers on the web and see if there is one close to you. If not, I would contact Winnebago. Your dealer may have had someone do work on your new MH chassis that was not done by an authorized repair facility.

The only way I could see that happening is if the dealer is very, very far from a MB service center and the repairs were relatively inexpensive. I can't see the repairs you described as fitting that bill. Something doesn't sound right to me.

If a dealer went outside the authorized repair network and put in rebuilt parts, I would think Winnebago would want to know about that.

If this is the case, that's one sleazy dealer in a hurry to make a sale. You should call them out on this forum by name.
