They also track your location (you can not opt out)any time they want and supposedly are doing so. Their reasoning is that it will assist in fighting crime. I guess there is an advantage to owning a dumb phone.

They should still need a warrant to get the data from the cell phone company even if they don't need a warrant to access your cell phone.2. When you use or carry a mobile phone, you're constantly broadcasting your location and other details on a semi-public radio frequency. There has never been any reasonable expectation of privacy associated with this. You should never say or do anything on a mobile phone that you wouldn't broadcast over a CB or say live on the 6 o'clock news. As for your ability to "opt out" of having your location tracked, anyone can do this at any time. Every phone has a built-in function called "off" that does exactly that.

It does.

Obviously not for data it doesn't. And for phone metadata.

I have had a smartphone for about 4 years now. The latest being a Droid. I find it more of a distraction. My next phone "upgrade" may in fact be a downgrade. If I can find a non-smart phone that has a decent calendar function I will be going that way.

Survelance of private citizens has been going on for years, and the only reason it is an issue now is that the media needs something to do. Why worry about what the government is doing, when private phone companies are and have been tracking your location, texts, credit card information, SSNs and lot of other information for years. On top of that, most of the data is stored on NON-secure databases, and is regurarly sold to marketers all over the world. DEon't worrry about what the government is doing, they are so inefficient and too politicaly hamstrung to get anything done, UNLESS someone with a lot of money wants them to. Just don't make the rich ones mad. they have lots of money to pay expensive lawyers to make life miserable of the rest of us in they want to.

It's phone LOCATION information...I don't see why it would be any more protected than the location of the land line that runs into my house. The Man still has to get a warrant to access the calls made from the phone, and pin the calls to an actual person. Just like the old days!
