The maximum on the sidewall is, of course, the maximum cold pressure. The tire manufacturer sets it knowing that the tire will heat up and the pressure increase when it's used, and so running at the max load and pressure is OK and within the design spec even though the hot pressure is higher than the cold pressure.
Blindly inflating tires to their max cold psi with out knowing what they are rated for at that psi, and what weight they are carrying, means you don't know if they are over inflated, or correctly inflated. One really needs ALL the information before stating I run max, that is what is on the side wall!
Many OEM tires are just enough to carry the load, so yes Max is correct, but then there are those that upgrade to a better tire with more capacity, and now max is over inflated.
Only proper inflation gives you maximum traction.
