  • and those signs that claim no responsibility for theft/damage/etc. are just that, signs.
    bumpy
  • Ran into on their property on their watch, their insurance should pay. If permission was given for Rv to be on their property, they took responsibility for it while there. Maybe different in the US, but I am thinking not.

here the whole story....we traded in our 5th W and truck for a used RV in December, scheduled Pick up in January...2 days before going to pick it up....a car ran into it... .after all my own work...because the dealer did not do much, we discovered that the driver has no insurance, drove without a driver license....the dealer told us to use our own insurance and requested that we take away the damaged RV from their property because it was taken space on their lot AND stil 6 mos after we are still waiting to have our RV fixed by a third party...is there anyway we can find some comfort into this whole nightmare

Is this the dealer you traded in the old/ bought the new rig from?

I'm unclear as to exactly why/what it was doing at the dealer's- highlighted portion above makes me think YOU were working on it on his property. Was that just an informal sort of situation with his permission, or was it there because he was supposed to be completing some work before you took official delivery?

Who had legal "possession" at the time of the accident is probably important here...

  • As this is your first post, you might want to take the time to fill in your profile. Helps.

Take two aspirin and lie down with a wet rag on your head? ;)
Just a little joke to lighten the mood...

For recovering monetary damages, as stated earlier:
If the dealer's denying responsibility, report to your insurance company and let them work it out.
  • If it's a brand new RV, I would request a replacement. Already used, let insurance (theirs) repair it.
  • Who smashed your vehicle? If it was a visitor to the lot, you recoup from their insurance. Do you have uninsured motorist on your policy?

Put the claim on your collision insurance and the insurance agency will try to recoup from the dealers insurance.
  • I assume you have already notified your insurance agent? let them work it out.

  • Whoever did the damage hopefully has insurance to pay for repairs. If the dealership personnel did it, they should take care of it. In worst case, uninsured motorist coverage should be used.
