There are 2 concerns here. One is the additional load on the MH brakes. Probably not a concern unless you are doing a lot of downhill towing, or driving in stop and go traffic and using the brakes a lot.
The other concern is the breakaway brakes. That's not a distance thing. The coupling between the MH and the toad can fail any time. Then the toad keeps going until it hits something if you have no breakaway brakes.
I know nothing about the legal aspect.
