I disagree on so many levels. If your dog can reach me unimpeded, IMO that should be considered assault. Next if it reaches me and I feel "threatened", my call not yours, you should be arrested and your dog removed from your responsibility (or lack thereof). I choose not to elaborate. But if you have been attacked by ANYTHING, you might understand.
There are defined definitions for assault.Assault is not an off leash dog. Assault is not a dog that can reach you unimpeded. There is no mention in the OP's original description of attacks or the dog threatening anyone. Let's at least try to stick to the facts and not create imaginary scenarios. There is also no mention of the dog unloading #2 anywhere. Common sense has left the building.
For the record:Perceived threat got at least one man a not guilty for murder, state specific crime. Hypothetically, who makes that determination. You are correct, in my opinion. However, unless you find a person irrational, are you in control of your dog if it is not leashed? Semantics maybe, for a court to decide. In my defense, when the dog reaches X from my person, what determines a threat? If I am not present in my safety zone, train, play, whatever. Still, the issue remains.
If I witness someone pull in next to me and take there unleashed under control dog to the beach and return I will not be upset or bothered in the least bit.
Now if the unleashed dog is out of control, disturbing the peace, or crapping everywhere that is a different scenario. However we need to separate fact from fiction.......Back to that common sense thing.
Maybe I turn up the heat. I come over, stand by you, and start sharpening my machete. I'm not threatening. I have no criminal record, short hair, and I'm shaved. How's your karma responding now?
