Sue, Im going through the same decision right now. I've been an over the road trucker for the last twenty ++ years, and deal with the problem of weight on a daily basis. We have many more regulations than you and any violation has the potential to send us to prison for many years. Our equipment ratings far exceed the gross vehicle weight ratings. If your gvwr is 11500, and you weigh 11510, then you are overloaded in the eyes of the law. Should you have an accident in which you are not at fault, a good lawyer can and will hold you liable for the accident if you are overloaded. There are several truckers that are now in prison for vehicular homocide or manslaughter, because of a minor violation. That said, I've not heard of anything like this happening in the RV community {yet} but Im not taking the chance. Just food for thought. Ernie
These are pretty serious statements. Could you please provide links to laws, or sources to support them?
I have ask many times during the past ten years for a link to a vehicle code in any state that says the door sticker is the legal weight capacity. We are not discussing vehicles for commercial use, which is very different. It is my understanding that one or more Provinces in Canada has laws using the door decals, but so far no one has posted such a law in the USA.
I worked in the prison system for over twenty years, and was on the board for case reviews. I have not met every inmate, but can say I have never heard of one in prison for the reasons you stated.
But this would most likely not be a criminal go to jail matter but a Civil matter. Therefore if it ever comes up it would be settled using insurance....
Trust me if someone runs over my family because they are unable to stop in time and they are driving a F350 SRW with a 1191 on it I will be damn well making sure my attorney is aware of it.
And being over the GVW, while not being a legal/DOT issue for TCs. Would be a great point in a civil case in front of a jury.
It is likely so rare because of the millions of cars on the road each and every day, how many are RVs? Then how many would be Truck campers and of those how many would be grossly overweight truck campers that end up being at fault in an accident. Likely a very very very small percentage over a year. That is why we don't hear about it. This is what insurance takes care of.
