Do I have any recourse?

I should have known when orig. salesman didn't know about unit for sale, and no picture online, that there might be a problem. This was for a used 2011 21BH Cataline TT bought in the state of IN.

Provided listed stock # and salesman was able to find unit. Arranged for inspection. Showed up and salesman was busy, so another person showed me the unit. Immediately upon walking into the TT, there was a piece of luann on the floor to the right of the door. Person showing even commented on wonder why that there.

Didn't discover any forthcoming problems and put money down on Sat. Unit wouldn't be avail. until Wed. for pickup. Systems had to be checked.

Upon pickup, all tanks had been filled to check out systems. Clean tank had busted supports and was resting on axle. I mentioned this but really needed to get trailer on the road to new job. Drained tank for ride home and fixed support issue at home.

After walking inside trailer where luann was, there was a soft spot. Pulled up linoleum to find a rotted spot approx. 1x1 foot. I also proceeded to fix this.

Called dealer to speak with salesman. He was so apologetic and said he would speak to GM about issue. I had paid asking price of $9995, no haggle. Then requested $1000 in return for issues. That was Sat., this is Wed. and no response.

The bill of sale does disclose "as is". But I'm wondering if such problems, especially the known rotted floor should have been disclosed. Appears to be shady deal to me.

Where to from here. Email dealer? Contact BBB? Chalk it up to me being a dumbass............
  • If the sale was "As is" then there's not much that can be done. You had the opportunity to inspect the unit, and you even found issues before you took delivery. You also had the opportunity to decline on the deal. You went ahead and took the unit. The dealership did nothing wrong. They did not try to hide anything from you, and you did walk on the floor before you purchased. You evidently were OK at the time of sale. No, I don't think you have any recourse. BUT, I think it's perfectly OK to contact the dealership and see if they will negotiate anything with you. You've got nothing to loose, so why not try. Just be prepared to receive a "no" for an answer, and move on gracefully and professionally.

    You gonna end up with a 2011 Trailer which is not all that old... To me that size up to the 24-25 foot length would be the perfect size. Easy to tow and will fit most camp grounds and Natl Forest sites with ease.



    If your fixes went well and after a good inspection of all other possible problems you should be in good shape for a long time to come..

    What are other 2011 similar TT's going for...

    Knowing what you have now is worth alot to you as the next used trailer will most likely have different new problems for you to fix anyway...

    AS-IS is just what it means AS-IS... You will be at the mercy of the goodness of the dealer... Some places has the so called lemon-law where you can return it in a 'very short time' after taking it off the lot...

  • We were told we had three days after pick-up to cancel the deal. We purchased in Indiana as well.
  • You must have needed a TT in a hurry, as you posted.
    If the dealer has any ethic at all, he should settle up with you on the damage discovered like the floor and tank.

    If it was me, I'd be getting a pressurized leak test done to discover if there are other issues like the roof or walls having leaks. I do the pressure test using a furnace blower, directing the air in through a window and spraying all over the exterior with a spray bottle of soapy water. I've seen where other guys use a leaf blower or a commercial fan, anything that moves a lot of air will do the trick.

    Don't beat yourself up too bad, we all get in a hurry and miss something now and again. Doesn't make you dumb, just a guy trying to get along. I'd keep on the dealer and salesman until you get some settlement.
  • Honestly no, and I would not pursue anything more than you already have. If they are nice enough to do something for you then great - but they're in business to make money and I don't feel they owe anything more. And I wouldn't go to the BBB either because the company did nothing wrong.
    You made a deal and accepted the unit As-is after inspecting it to your satisfaction. Now it's time to roll up your sleeves and go to work on it and accept personal responsibility for your actions.

  • You could try BBB. In Wisconsin we have a state agency called the Dept. of Ag, Trade and Consumer Protction that mediates these type of complaints. One would think water damage should have been disclosed, but you took possession of it without a thorough PDI and bought "as is".
