I believe if you are in an accident and you are overloaded they will use that against you. Happened to my aunt's ex years ago. He severely overloaded his vehicle and therefore was at fault for the accident.
I do purchasing of all vehicles and equipment for my employer. We DO NOT purchase a vehicle that is under the GVWR, tkre ratings, GAWR, etc., that we need to use it for. That is for liability purposes. If we tell an employee to tow/carry more than the vehicle is rated for, then we are liable if the employee is in an accident and the overloading can be even partially to blame for the accident.
