I call BS to that. If he was found at fault for negligence then it would have been regardless if he was over the manufactures payload rating or GVWR. If what you say were the case, then just about every state would get sued for registering vehicles to carry more weight than what is on the factory sticker which is very common.
The main reason for using GVWR for vehicles classification is for emissions standards and USDOT highway standards for different classes.
