If it went to court you better believe that the driver or owner of the wheel would have to explain weather they followed manufacturers instructions? If you didnt (no one told him to check the lug nuts) you sure would be open to negligence!
Had a co workers wife get seriously injured from an incident just as this. The car that lost the wheel just came from a tire shop, The shop and the owner of the car were sued for negligence, Owner stated he assumed it was done properly by the shop but stated he never even looked or checked. Shop stated they used a torque wrench before it left the shop!! They were negligent because the wrench they submitted for evidence was never Certified annually!!
Never assume anything,,The Driver is always responsible for their vehicle!!
