A lot depends on the car the location of the components, but overfilling can potentially force fuel into your evap system, which can cause issues with your charcoal canister and/or trigger a CEL.
Diesel foams up and the foam triggers the auto shutoff on the pump. If your tank is "normal" with the airspace at the top and you have not installed a vent in order to fill that space, then you can safely fill it to the brim. Any expansion will be handled by the air space compressing the air as the fuel expands.
