Many tuners diesel tuners today offer emissions intact tuning that turns off the EGR so you you don't have to delete it while still keeping the DPF and SCR. The EGR is the worst of all three because it introduces exhausted air back into the engine creating even more soot all in an effort to reduce NOx. Turning it off significantly reduces regens and the SCR/DEF system is utilized more to reduce NOx after the engine which means the engine can run at peak performance/efficiency. Cummins and VW are coming out with dual SCR's and eliminating the EGR altogether for other markets.
Although, it is ironic regarding the legality of it since the EPA did not abide by the law when making many of these regulations and used the judicial system behind closed doors to bypass the legislative system with their sue and settle tactics. If the ones making the regulation did not do it lawfully, which bypassed the people's input through their legislative representative, then should it even be a law?
