RV tv/gps theft

My rv was at camping world katy tx. Phone call rv broken into tv's stolen in dash gps stolen. Camera's not working and we are not responsible for any theft. They said the lot is secure and they have camera's. Anyone have any advise I have insurance but I have to pay deductible. Camping World has no responsibility?
  • This might be a good question for the "Dear Marcus" section of the Forum. If Camping World wants to retain your business, they may split some of the cost with you.

    I've worked in a few garages and the liability always remains with the owner for theft and damage. As was posted, most service contracts have the absolution of liability for the business in small print.
  • Smitty kinda has something there.... If they articulated what"secure" means in their waiver.... You might be able to prove otherwise based on actions of the business and their employees.
  • Security cameras are really only useful for hopefully identifying offenders. They don't stop theft. The fact they have a "secure" lot is left open to one's interpretation of what "secure" is. I rented a place to store our MH for several years that advertised itself as "secure" with "cameras." It also had a barbed wire topped fence around it with a keypad entry and the manager lived on property. What really made me feel my MH was safe was it was kept inside a locked garage while inside the fence. They never had any break ins or thefts in all the years I rented there.
  • When you took it in there you probably signed a disclaimer absolving them from responsibility. Common business practice.
  • They are correct, generally speaking. However, if they made a promise to you that the lot is secure, then you may have a case. But I doubt they would just roll over and pay you and set a precedence. You'd have to go to small claims court.

    Generally speaking when your RV gets broken into the only people responsible for the damage are you and the people who stole your stuff. The owner of a storage lot or a repair facility won't be responsible, unless you can prove some type of negligence or a breach of a contract on their part. For example if they left the motorhome unlocked, or they promised you there would be a security guard at the lot 24 hours a day and there wasn't, or if one of their own employees broke into your motorhome or conspired with the people who did. Just saying "the lot is secure" probably won't get you there.
