Security Guard or Security Monitor?

We had an intruder last night into our gated, secure resort park, Chula Vista near San Diego. A mid-20's female was found this morning by our neighbor's wife asleep in an outside chair. Quite startling. Security was called and two guards showed up to roust her.

In her possession was the handout we all get: the park map containing gate and restroom codes. She decided to run away from the guards and was not found after a search by local police.

Guards say they are banned by the resort's policy from detaining anyone trespassing. Lots of campers are very unhappy with this resort policy. She was just a homeless street urchin but what if she was a he and meant harm to the campers? Lots of elderly here. Security guards or Security monitors? You know the TV commercial.

Chula Vista needs to change their policy so the guards can detain and we campers need to call the police in the future as the guards are useless per current policy.
  • I've had the license and have taught the firearms part of the Virginia security guard programs. I cant speak to all states but here, for an UNarmed security officer, you are to;
    1. Observe
    2. Report
    3. Advise people of the property OWNERS rules.
    Unarmed security is taught not to confront or detain under any circumstance.
    Armed has arrest authority, however that authority comes from the property owners authority as the owner. I have seen shoplifters walk out after being caught because the store managers did not have the legal authority, to detain. In those cases all they can do is photograph, document vehicles involved and give law enforcement the information when they arrive later.
    Virginia is a Commonwealth, not a state, as such the laws are somewhat different than some areas.
    Chances are in Kali, their ability is even more restricted.

    I would suggest anyone with a seasonal site or who frequents the campground regularly ask for a meeting with campground management to ask why the policy is such that the guards can't do more than stand there. There may be legal issues involved or the campground just doesn't want to take on the liability of some Rambo going overboard. I'd also suggest that the handouts with all the info on them be kept inside and handed out as needed. If this was a one-time occurrence I wouldn't get too worried but if you see a trend then it is time for some action.

    It's possibly a local or state law, not the campground policy, that does not allow security to detain trespassers.
    And maybe she was staying at the CG and got too drunk (or something else) to find her way back to her RV. Security showed up, woke her and she ran back to where she was staying. That could be why the police did not find her.
  • The homeless in San Diego are being rousted from their normal spots due to an outbreak of Hepatitis A. Efforts are being made to clean the areas where the homeless normally spend their time. Homelessness is becoming a large problem in most major and medium sized cities throughout California. She found a nice spot to spend the night while her regular spot is being cleaned with a bleach solution....

    Most security companies/guard can only observe and report.
  • Charge her with trespassing she'll get a ticket and summons and not be back or show up for her hearing. If she gives the police problems she may get a night in the graybar hotel.
  • I'm kind of curious as to what you thought they should do with this individual over an above escort them off the property?
  • No they should not detain they are not law enforcement. If they detain someone wrongly the resort will be sued for all the money in the world.
    If you are not happy with the policy "the road out front runs both ways toward and away from the camp ground"
