Most companies work through a company called Arbitration Forums. For smaller claims everything is submitted in writing. There is no chance to state your case verbally or meet face to face. So basically, if the person who got your case had his wife leave him, his dog died, and his daughter got pregnant that morning, you can pretty much be assured that your case is gonna get tanked.

Arbitration is designed to give the Insurer/Big Company/etc the edge in a case. If this were not true, then there would be NO companies wanting to use this system to decide the fate of a case/litigation.
And if it is a fight between 2 insurance companies (one of them being the people representing you), can it be proven beyond a reasonable doubt that the arbitrator is totally unbiased and is not being influenced by an outside force (i.e. the other company)?
That is why we have courts in the United States. To have the ability to have several people come to a conclusion after seeing all the facts in your case. And then decide your outcome.
Unfortunately, the ability of the "little people" to raise their voices and have their say is being stomped out by corporations who are ONLY in it for the money.
