If you swerve to avoid anything and are the only vehicle involved in the accident, you are the one at fault, period. Who else could it be when no one else was involved. I have had a person turn from the incorrect lane, thru traffic causing an accident, but because that person was not involved, the last vehicle in the pile-up (me) was automatically the at fault driver. The police were there, but they could not ticket that person(now parked at a nearby restaurant) even with 3 involved drivers indicating this is what happened. I myself don't see anything shady about the handling of your claim other than the uncalled for remark made about chasing the vehicle down. You also should understand that hundred's of people every month make these type of false statements trying to get out of paying their deductibles, or to have additional coverages by not being at fault. You would never believe the stories unless you yourself sat and listened to some of them. I have.
