I think it depends on the insurance company. My insurance company will makes a case by case determination for phantom drivers. Phantom driver cases are paid based on the uninsured motorist coverage. Most problems people experience with phantom drivers is because they never took the time to read their policy and know exactly what the company said is their policy and practices. Even worst, bet most never even asked about it.
