It doesn't matter if you torque it. If it's a sheet metal pan which I cant imagine it's not the bolt area is compressed into the old gasket and it will be the first area to contact the new gasket and there will be a pucker effect in the area between the bolts and it wont seal. DING the pan. :)
x2 - have seen this several times during my previous life as a mechanic.
Although it is also possible to warp the pan if it is not tightened/torqued in the proper sequence. Have seen that before too, and learned that the hard way.
My take - mobile mechanic owes you the fix
