That may not be as clear cut as you think.
There are two types of headsets, (Actually 3 but) Single Ear Mono, these are often used for this type of communications, cover ONE ear only. These MIGHT be allowed in states where the next type are illegal:
And Dual ear (mono or stereo, why it's 3) these are illegal in many states.
Also there are headsets that do not cover the ears, a properly worn Plantroinics Telephone star set is an example of this, the ear piece lies in the ear lobe and delivers sound just outside the ear,,, However these are not compatable with your 2-way radio less you happen to know how to adapt them (Which as it happens I have done).
They are also very expensive.
