I kind of like the idea of the bars going up and eliminating clearance issues. Also, it seems pretty neat that the bars don't move, rather they pivot on a center shaft contained in the head. From the video it shows the friction material is contained inside that pivot point and you adjust your sway tension using a clamp bolt.
Obviously your experience has been frustrating but it does seem like an interesting concept. I'll be curious to see if others try this hitch and if they are successful.
