I asked him to go weigh his truck with a full tank and him in it forma bttr number. I just wanna make sure he wont exceed 10400 lbs whe he is going down the road.

Payload is the KEY.
1439 is what is available for your passenger and gear weight in the vehicle PLUS your tongue weight.
If you take 400 lbs off for passenger and other gear in the vehicle you get 1039 lbs left for the TONGUE WEIGHT.
Working backwards with 1039 lbs for tongue weight assuming 10% for the tongue weight of the trailer that would give you a trailer of 10,390 lbs.
However it is better to have 12%-15% tongue weight so we recalculate that as 8,658 lbs for 12% and 6,926 lbs for 15%.
Your brother should be OK with a trailer weighing 7K lbs-8.6K lbs LOADED.
That would be trailers weighing 6K-7K empty IF YOU PACK LIGHTLY(but who REALLY tows empty?).
Others will disagree but the cargo weight is the limiting factor...
