Your DMV/DOT overweight penalty is no big deal. For me it is $0.01 a pound plus processing fees. DMV/DOT reporting your violation to your insurance company is a big deal.
Warranty work depends on how sharp is your service manager/district service manager? When they see front hitches, Timbrens, helper springs, air bags, sway bars, and SuperTruss hitches they see red flags. After the Ford/Firestone and GN recalls, don't expect manufactures to be very tolerant.
A civil suit is the most concerning and it all depends on how sharp is the plaintiff. If very aggressive and they can substantiate you bring overweight, you are at fault. Granted the odds are very high in your favor BUT then again its not uncommon to read about people going to prison for vehicle homicide when there was a death related accident. Scary isn't it?
